NEW ERA 2025 DESIGN-A-THON OFFICIAL CONTEST RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

By taking part in this Contest (as defined below) you accept and agree to be bound by these Official Rules and agree that all decisions of Sponsor are final and binding. These Official Rules apply only to this Contest and not to any other promotions, contests, sweepstakes, or giveaways sponsored by New Era.

SPONSOR: This Contest is sponsored by New Era Cap, LLC 160 Delaware Ave., Buffalo, NY 14202 (“New Era” or “Sponsor”). 

​

CONTEST PERIOD: The NEW ERA 2025 DESIGN-A-THON CONTEST (the "Contest") takes place from March 14, 2024 at 5:00 PM (EST) through March 16, 2024 at  4:00 PM (EST), (the “Contest Period”). 

ELIGIBILITY, RESIDENCY AND AGE: The Contest is open only to legal residents of the United States 18 years of age or older and: (1) enrolled full-time as a Junior or Senior at Buffalo State University, (2) in the Fashion and Textile Technology program, (3) in good academic standing according to the academic advisor in the aforementioned program; and (4) fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Rules (each, a “Participant”).  ONLY INDIVIDUALS will be recognized and accepted as Participants, not businesses, companies, stores, partnerships, or other legal business entities.   Employees, officers, representatives or agents of Sponsor, the Released Entities (as defined below) and their respective affiliated entities, agencies and production agencies, and their immediate family members (spouse, parents, siblings, children, in-laws, grandparents, grandchildren), are not eligible to enter.  This Contest is subject to all federal, state and local laws and regulations. VOID WHERE PROHIBITED, TAXED OR RESTRICTED BY LAW.

HOW TO ENTER  THE CONTEST :  To enter, Participant must, during the Contest Period, (1) visit https://www.neweradesign-a-thon.com/ to receive a registration form (“Registration Form); (2) complete the required information on the Registration Form, including a three hundred (300) word essay (“Essay”) explaining what New Era’s core values mean to the Participant and how the Participant would apply it to the Contest (the Registration Form, together with the Essay and any additional materials submitted by Participant, are collectively the “Application”), (3) submit the completed Application  prior to the end of the Contest Period. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, illegible, mutilated, invalid, unintelligible, or misdirected entries; all such entries will be disqualified. No facsimiles, mechanical reproductions, alterations or forged entries are permitted. LIMIT ONE ENTRY PER PERSON.  ALL APPLICATIONS MUST BE IN ENGLISH AND MUST COMPLY WITH THE APPLICATION RESTRICTIONS SET FORTH HEREIN.   The Participants’ Application score will be determined at the discretion of the Sponsor, and based on the strength of the Participant’s Application. Participants with the eighteen (18) highest scores at the conclusion the Contest Period will be named a contestant winner to compete in the below defined Design Competition (a “Contestant Winner”).  Decisions pertaining to the selection of Contestant Winners are final and binding.  A waitlist for additional applicants in excess of the Contestant Winners (“Waitlist Applicants”) will be created if more than eighteen Applications are received. The selection of Waitlist Applicants will be the same as the Contestant Winners.

NOTIFICATION TO CONTESTANT WINNERS:  On or about February 21, 2025, after the conclusion of the Contest Period, the twenty-four (24) Contestant Winners will be announced and are at the sole discretion of the Sponsor . The Contestant Winners will be notified by email and/or phone with an offer (“Offer”) within two (2) weeks after the close of the Contest Period. If a Contestant cannot be reached within seven (7) days OR in the event a potential Contestant Winner does not accept the Offer within seven (7) days OR in the event a potential Contestant Winner does not comply with these rules, the offer to compete in the Design Competition will be forfeited. If a Contestant Winner declines the Offer to compete or they are forfeited, the next person on the Waitlist Applicants list will be extended an Offer. In the discretion of the Sponsor, the Contestant Winners will be divided into teams as described below for the design competition contest (the “Design Competition”).

DESIGN COMPETITION PERIOD: The Design Competition will begin on 5:00PM (EST) on Friday, March 14, 2024 through 4:00 PM on Sunday, March 16, 2024 (“ the Design Competition Period”).  

 

DESIGN COMPETITION : The Design Competition will last for the Design Competition Period. A team of 4 Contestant Winners (each a “Design Team”) will be formed and notified to Contestant Winners prior to the first day of the Design Competition Period by Sponsor in its discretion. The Design Team will use materials (“Materials”) provided by the Sponsor to design a non-wearable fashion item as a piece of art (“Design”). The Design will be based on themes and specifications provided by the Sponsor. The winning Design will be displayed in the Sponsor’s atrium at its corporate headquarters location. The competition specifics are subject to change at the discretion of the Sponsor. A formal schedule of the timeline will be delivered to the Contestant Winners in their Offer. 


DESIGN RESTRICTIONS AND REQUIREMENTS:  Sponsor reserves the right to and will review each Design and reject any Design in its sole discretion for any purpose or any reason. By submitting a Design, each Contestant Winner warrants and represents that they consent to the submission of and all uses of the Design or Designs including but not limited to the display, copying, modifying, editing, and posting of the Design on the Internet or in emails, web blogs, and/or print advertising, in connection with advertising, marketing, promotion and voting of and for the Contest. 


EACH DESIGN: 


(a)     MUST be the original work of the Contestant Winner; 
(b)    MUST respect Sponsor’s brand image; 
(c)     MUST have been created in a legal and safe manner;
(d)    MAY NOT have won previous awards;
(e)     MAY NOT have been previously published;
(f)    MUST NOT contain any viruses, hidden Trojans, worm or other malicious/harmful software or computer programming;
(g)     MUST NOT infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;
(h)     MUST NOT display any identifiable commercial product brands or licensed logos, except those of Sponsor; 
(i)     MUST NOT display any designer insignia, logos, or trademarks;
(j)     MUST NOT display any identifiable person for which the Contestant Winner has not obtained the necessary written clearances;
(k)     MUST NOT display any visible phone numbers, website links, street addresses, e-mail addresses, license plate numbers, area codes, zip codes, or airport codes;
(l)     MUST NOT display any obscenities, profanities, vulgar language, lewd behavior, or offensive, obscene, or inappropriate content for a general audience;
(m)     MUST NOT display any nudity or any sexually explicit depiction;
(n)     MUST NOT display any depictions of violence;
(o)     MUST NOT display any illegal act or an unsafe action;
(p)     MUST NOT display any gang-related materials, gang affiliation, gang support, or gang activity;
(q)     MUST NOT display any derogatory, disparaging, libelous content about Sponsor, Sponsor’s competitors, or any entity or person;
(r)     MUST NOT display any discriminatory depictions based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference;
(s)     MUST NOT display any depictions of guns, knives or any other current and/or historic weapons; AND
(t)     MUST NOT display any illegal drug use or paraphernalia, or any other element that does not comply with the theme and spirit of the Contest.

 

Designs which do not conform to these guidelines will be disqualified. Sponsor further reserves the right, in its sole and unfettered discretion, to verify at any time during the Contest that all necessary clearances have been obtained and to disqualify any Design if it believes that the necessary clearances have not been obtained. 


DESIGN OWNERSHIP:  Contestant Winners agree to be bound by these Rules and the decisions of the Sponsor which are final and binding in all matters relating to the Contest. By entering, a Contestant  Winner agrees that each Design they submit becomes the sole property of Sponsor and that the Sponsor may use such Design for any proper purpose. Any personally identifiable information collected during the Contestant Winner’s submission of any Designs, Registration Forms, and/or Applications will be collected by Sponsor and used by Sponsor, Sponsor’s Agents and their respective affiliates, and agents for purposes of the proper administration, marketing and fulfillment of DESIGN-A-THON CONTEST as described in these Rules.  By submitting a Design, the Contestant Winner irrevocably assigns, conveys and otherwise transfers to Sponsor, its successors, and assigns for no compensation, exclusively and in perpetuity, any and all right, title, and interest, worldwide, in and to the Design(s) the Contestant Winner submits, including, without limitation, any and all copyrights, trademarks, trade dress, likeness, image, contract and licensing rights, moral rights, and other intellectual property and proprietary rights in and to the Design(s), along with the exclusive right to edit, change, revise, reproduce, display, perform, publish, distribute, license, sublicense, and sell the Design in whole or in part, and to prepare, use, and exploit derivative works or improvements thereof, in all forms and media now or hereafter known, including material in digital and electronic media, computer, audio and audiovisual versions, and translations and adaptations, all in any language throughout the world in Sponsor's sole discretion.
 

CONTESTANT’S REPRESENTATIONS: By entering this Contest, each Contestant Winner warrants and represents that Contestant Winer’s Design / Application: (1) does not infringe the intellectual property rights of any third party, (2) does not invade any third party's privacy rights, (3) does not libel or slander any person or entity, (4) does not contain anything that is profane, vulgar, lewd, or otherwise obscene or inappropriate for a general audience, (5) has not been published in any medium, and (6) is original and has not won any other award. 

 

SELECTING THE DESIGN COMPETITION WINNERS: After the Design Competition Period closes, a panel of judges selected solely by the Sponsor will judge the Designs on or about Sunday, March 10, 2024, and will determine the final winners/winning Design Team.  Judging will be based on the following criteria, which are subject to change at the discretion of the Sponsor: (1) originality, (2) creativity, (3) individuality, and (4) overall style of the Design. Decisions of DESIGN-A-THON CONTEST judges (“Decisions”) will be made based on their experience and at their sole discretion. These Decisions are final and binding. The top three Designs as determined by the Judges will be the prize winners. 
 

NOTIFICATION TO WINNER:  On or about Sunday, March 10, 2024, at the conclusion of the judges’ selection and review process, the winners will be announced in person.


PRIZES:  One (1) grand prize winning Design Team will receive $1,500 (total) in the form of gift cards and the opportunity for an internship (for each team member) with Sponsor during the 2024 summer following the Contest, with such internship conditional upon and subject to satisfactory completion in Sponsor’s discretion of an application for employment and background check. One (1) second place winner Design Team will receive $750 (total) in the form of gifts cards. One (1) third place winner Design Team will receive $300 (total) in the form of gift cards . Prize winner(s) are also responsible for all federal, state and local taxes, including completion of W-9 taxation forms.  The odds of winning any prize depend on variables including,  but not limited to, the number of eligible entries during the Contest Period, the quality of Applications submitted, and the skill of the entrant(s). Limit one prize per Design Team.


NOTIFICATION TO WINNER:  The winners will be notified in-person by a New Era representative on or about March 10, 2024. If a potential winner cannot be reached OR in the event a potential winner does not accept the prize or fails to comply with these rules and requirements, the prize will be forfeited. Upon prize forfeiture, no compensation will be given and New Era will have sole discretion to select another winner.  The prize is non-transferable; the prize cannot be substituted for another prize; the prize cannot be sold; and the prize cannot be redeemed for cash from Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the prize is unavailable.  The winner and any guest(s) shall be required to complete and sign a Winner’s Affidavit (as outlined below) and/or other documents if required by Sponsor when such winner claims his/her prize.  Failure by the winner to sign any requested documents or failure by the winner to comply with any terms in these Official Rules may disqualify the winner in New Era’s sole discretion and winner may forfeit his or her interest in the prize.

 

CLAIMING THE PRIZE: To claim the prize, the winners must each sign and return to the Sponsor within three (3) days of being contacted by Sponsor a Winner’s Affidavit.  If for any reason a winner fails to properly complete or return an Affidavit or fails to comply with any terms in these Rules, then at the discretion of New Era, the winner may be disqualified and forfeit the prize. New Era may, in its sole discretion, decline to accept an Affidavit if it is not signed by the same person who signed the Registration Form. Except as limited by the law, acceptance of any prizes or any portions thereof will constitute each winner’s consent to the use of their name, likeness and/or image for advertising or promotion by New Era and assignment of ownership in the Design without additional compensation.

 

GENERAL CONDITIONS:  This Contest is intended for participation in the United States only and shall be construed only according to United States law.  Participants agree the Contest is governed by New York state law. 

 

By entering the Contest, entrants agree to be bound by these Official Rules and agree: (1) the Sponsor, Buffalo State University and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, and advertising, marketing and sweepstakes agencies may use (unless prohibited by law) the entrant’s name, voice, city/state of residence, photograph, and visual and/or audio likeness for advertising and/or trade purposes, and for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; and (2) to release and hold harmless Sponsor, Buffalo State University and each of their respective advertising and sweepstakes agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, or participation in this Contest, or possession, acceptance and/or use or misuse of the prize(s) or participation in any Contest-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor, Buffalo State University and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, and advertising, marketing and sweepstakes agencies shall be collectively referred to as the Released Entities.

 

ADDITIONAL TERMS: Any other attempted form of entry not specified herein is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. 

 

Sponsor, the Released Entities and each of their respective affiliates, partners and sweepstakes and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions or other errors of any kind, whether human, mechanical or electronic, which may occur in the entries for or in the distribution of prizes in this Contest. 

 

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Contest should it determine, in its sole discretion, non-authorized human intervention or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor.  

 

Potential winner(s) may be subject to a background check of any and all records at Sponsor’s sole discretion, including without limitation, civil and criminal court records and police reports, and entry into this Contest constitutes consent for Sponsor to conduct such background check.  Entrant(s) and Winner(s) may be disqualified at the sole discretion of the Sponsor for any of the following reasons:  (i) if charged with or convicted of a felony or misdemeanor; (ii) if not eligible based on the eligibility requirements set forth in these Official Rules; (iii) if delinquent on a government ordered payment, including, but not limited to, child support, spousal support, alimony or tax payments; (iv) for violating the law(s) of any jurisdiction; and/or (v) for engaging in any activity or behavior which offends the public morals or embarrasses or puts the Sponsor in a negative light.

 

Any false information provided within the context of the Contest by any entrant concerning identity, age, eligibility, mailing address, telephone number, email address, ownership of right, or non-compliance with these Official Rules or the like may result in the immediate elimination of the entrant from the Contest.

 

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest.  Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.

WINNER’S NAME: A list of the winner(s) (grand prize winners only) may be obtained after the Contest Period, by sending a self-addressed stamped envelope to: NEW ERA DESIGN-A-THON CONTEST c/o Human Resources Department, New Era Cap, LLC, 160 Delaware Ave., Buffalo, NY 14202. Requests for Winner’s Name must be received no later than March 24, 2025.
